Errors & Omissions (E & O) Insurance for Producers offers specialized coverage for a wide
variety of media risks against the devastating impact of
lawsuits for libel, slander, invasion of privacy,
infringement of copyright and other specified torts.
Typically required when signing a distribution or
broadcast contract, your project is submitted to all
eligible, top-rated insurers, in search of the most
competitive premium.
E&O Provides coverage for
(but is not limited to);
Distributor’s E&O insurance differs slightly from Producer’s E&O in that distributors are insured for a list of titles they are distributing. So, under distributor’s E&O insurance, a distributor is indemnified against lawsuits arising from the content of Movie X and will still be indemnified against lawsuits alleging content errors for Movie Y. The available policy types are as follows: Occurrence-Basis E&O Policy: An Occurrence basis policy affords
coverage in perpetuity to claims arising from scheduled titles that
incur covered claims from the scheduled title that meet the policy
criteria for a trigger or an acceptable occurrence. Typical occurrences
for these types of claims, depending on the actual policy terms, may
include the sale, distribution or broadcast of the Scheduled Title. Claims Made E&O Policy: has provisions that dictate that the claim
must be made during the policy period. Although this may translate into
a slight premium saving, this policy type requires that the policy is
renewed or remains in force for multiple years for coverage to apply. In most cases, if an occurrence policy form is available, it may
serve your needs best.

While every project and policy are different, ballpark premium pricing for producers E&O premium starts at $2000.00 for a $1,000,000 limit per occurrence and in the aggregate with a deductible of $10,000 per occurrence for video on demand, DVD-type non-theatrical distribution.
